As always, Work Hard and Stay Humble. - The Transcar Express Management Team Notice Concerning the Following Policies Please take your time to read these policies very carefully. These policies are meant to clearly inform you about what you can expect from Transcar Express, and what the company expects from you. These policies do not constitute an employment contract, but rather provides for you a guideline by which our company operates. Nothing in this document or anything the company may give you or tells you to do should ever overrule the Federal Motor Carrier Safety Regulations (FMCSRs, the company has a copy of those for your use, in your truck). It is up to the driver to raise objections if and when necessary. As the driver of the truck, it is your obligation to know all relevant regulations & laws. Drive Responsibly. If you have any questions or concerns regarding any of this material, or the regulations please contact someone in the office before signing. Thank you, and welcome aboard! This document has been organized into three general sections for your convenience: Things you should know before you leave on your trip, things you should know while on your trip, and things to know for after your trip. While it is split into three categories to make it easier to read, you need to know all of it and will be responsible for knowing it all of the time. Initial Stating Understanding and Agreement *NextFMCSRs, Relevant Laws & Regulations We are excited for you to join our family by bringing your professional driving career to Transcar Express. As in every family, there are some responsibilities that you need to be aware of. The rest of this document will talk about Transcar specific responsibilities, but you are also required to know all relevant laws and regulations pertaining to your job including but not limited to the Federal Motor Carrier Safety Regulations (often referred to as the FMCSRs). A copy has been provided for you in your truck. Make sure you understand them, as well as all other relevant national, state, and local laws. When you are behind that wheel, you are wholly responsible for that truck, trailer, cargo, and their contents. Professionalism is Your Responsibility At Transcar Express, we don’t hire just plain and average truck drivers. We hire the best professional drivers in the business; men and women who are constantly pursuing excellence in their careers. This means that we want our drivers to constantly be improving. Excellence isn’t a destination, it’s a journey. A few ways that we show the world our professionalism is by always being on time and presenting ourselves in a clean and respectable manner. It’s important to be on time, and early if possible, because it shows our customers that we take their business seriously. It tells them that we want them to succeed, and that we are doing everything in our power to help them. Please make every effort to not only be on time, but to be early to every single pick up and drop possible. Keeping your truck clean, wearing clean clothes, and using respectable language is another way to show yourself as a professional. Law enforcement officers, shippers, and receivers will take you more seriously, and are more likely to cut you some slack if you are professional in these areas. Transcar Express expects the best of you in these areas and will hold you to them. You are responsible to take your things off the truck whenever you decide to leave. If you leave with out your belongings you will have ONLY 4 days to claim them. If you fail to leave the truck clean there will be a penalization deducted from your Escrow account. Company Property & Equipment Security You will be assigned a truck and all of the required equipment that goes with it. We do not ‘slip-seat’ like some companies but give you the truck to use for your entire time here at Transcar Express. Move into it and make it like your home. We will try to wash the outside of the truck each time it is back, but you are responsible to keep the inside of it clean too. When you are assigned equipment, you are the one who is responsible for all of it, all of the time. This is why we will ask you to do equipment count; so that you can double check the amount of each piece of equipment that the truck has. We want to give you everything you need to do your job well. This also protects you from someone at the company saying you had more equipment than you actually did, and this protects the company from you saying that you had less equipment than you did. It keeps everything fair, which is what we are aiming for. Every time that you are asked to use a different truck, if you aren’t asked to do an equipment count, request that you do one for your own protection. If an equipment count form is not filled out, the driver will be held to the most recent one filled out by a previous driver. You will be given a key to your truck, keep it safe. Whenever you are not going to be inside of your truck keep it locked, including here at the home terminal. It is your responsibility to make sure that all company and personal goods are kept secure. Transcar Express in not responsible for lost items assigned to a driver, or for personal items. This includes and is not limited to everything inside the truck, in the headache rack, inside a trailer compartment, and on top of the trailer. If you have good reason to believe that theft of company or personal property has occurred, report it the police and the company immediately (this check should always be part of your pre and post trip inspections. Double check everything. Ask the question: “Do I have everything I could possibly need for this trip?”). If Transcar Express believes there has been a theft, we will call the police and make a report as soon as reasonably possible. Theft by employees will be grounds for immediate termination and legal prosecution. Initial Stating Understanding and Agreement *NextFlatbed Lumber/Dunnage Eight pieces of lumber/dunnage (4’ x 4” x 8’) must be on your truck or trailer each trip. This is provided by the company at our terminal. Each trip it is expected that you will have this with you. Make checking for it part of your pre-trip inspection before leaving the yard, each trip. Not having it can result in making it your expense on the road. New Hire Reporting, Taxes, & Wage Garnishments For Company Drivers only, we withhold federal taxes. This includes: Federal Income Tax, Social Security Tax, and Medicare Tax. Owner Operators are expected by the government to withhold taxes themselves. Any questions about this please speak to someone in payroll. All tax related questions should be directed to a tax professional and/or lawyer. Transcar Express does not give legal or tax advice, and each employee is responsible for their own taxes. Company drivers can expect to receive a W-2, while Owner Operators will receive a 1099, at the beginning of the next tax year for all wages earned in the current year. As required by law, we will report your employment to the State of Texas. If at any time we are issued with a wage garnishment order (such as Child Support) from the State, we will garnish it exactly as ordered. Because all of our employees are paid on an “irregular schedule” we will take up to 50% of your disposable income each check until your commitment for that month is met, starting with the earliest check of the month. There are no exceptions to this. Drivers who drive trucks not owned by Transcar Express, are not employed by Transcar Express and therefore need to speak to their employers about all payroll and tax information. Mandatory Personal Protective Equipment (PPE) Every employee hired to a Truck Driving position needs the following protective equipment, at your own expense, before leaving on your first trip. This equipment must be checked and inspected by the office within 30 days of being hired. You shall continue to have the following equipment for the duration of your employment. If at any time, any of your equipment becomes unusable/unsatisfactory it is your responsibility to let the office know, so that you may be given appropriate time to purchase a replacement. Hardhat Steel toe boots Safety Glasses Safety Vest Long Sleeve Shirts, and Long Pants All PPE must be worn through the entire loading and unloading process. Your PPE may be inspected, and deems unsatisfactory by a company official at any time during your employment: Passenger/Ride Along Policy Having unauthorized persons in your cab, other than another driver that is not specifically employed by Transcar Express is strictly prohibited by the law (see FMCSR § 392.60). Doing this will be grounds for immediate termination. If you willingly have another person in your cab, you can and will be held responsible for any and all costs as well as liability associated with an accident or ticket. It is entirely possible that an officer of the law sees that you have a passenger and also sees that you do not have a passenger endorsement on our insurance, then you will be given a ticket and your passenger will be stranded wherever you are stopped. Please do not put yourself or the company in this position. Passenger endorsements are available upon request, and upon insurance company approval. Passengers must be over the age of 8, an immediate family member, and registered with the office. Costs and details of the policy are subject to change without prior consent or knowledge. Ask the office for the most up to date information. Initial Stating Understanding and Agreement *NextPet Policy For company drivers who would like a pet in the cab, that is perfectly acceptable. It will cost you $50 for each truck that you bring an animal into. This cost goes into the cleanup of the truck after you are done. This cost can easily be deducted from your next paycheck with Transcar Express. If it is seen that you have a pet in your truck without authorization, it will automatically be deducted from your check without notice. Parking of Personal Vehicles in the Company Yard When possible, plan on being dropped off & not parking in the company yard. If you are unable to be dropped off, driver parking is located at the end of the property. Driver parking is not allowed around the building or along the fence that runs with Frontage Rd. If parking is completely full, please do not create a parking spot somewhere else, but rather park outside the fence. Both sides of the fence are constantly monitored by security cameras. Transcar Express is not responsible for property damage or loss that occurs because vehicles have been parked in our yard. We will assist any theft or damage that is accompanied with a police report by providing all security camera footage that we may have of the time when the loss or damage occurred. Quarterly Safety Meetings Every quarter, Transcar Express will host a safety meeting for our drivers. The topics will be wide ranging and specific to job related duties. At a minimum, all drivers will only need to attend two of the four meetings each year, and all new drivers (less than one year of employment) will need to attend every one. If safety asks you to attend a specific meeting, you are required to go; however, it will count towards your two (or four) required meetings for the year. Initial Stating Understanding and Agreement *NextCheck Calls & Communication Every time you call into the office you should state your name and truck number – this makes things easier for our dispatchers and in return easier for you, especially when you are first starting. In order to provide better service to our customers and in order to get you loads quicker and easier, we require check calls at the following times: When finished at shipper and/or receiver Anytime your ETA changes If you are going to be in the sleeper berth/off-duty during business hours These check calls should include your current location, and your ETA to the next location, as well as your projected sleeper berth/off-duty times. Check calls can be made by phone or text message. Check calls are not required over weekends. Never do a check call or operate your cell phone while driving, see the distracted driving section. It is absolutely critical to our company that we are able to get a hold of you anytime that we need to. Excuses that do not work are: “I was sleeping”, or “I was off-duty eating”. If you do not want to be called by the company, call and let us know, otherwise we need to be able to reach you 24/7 – even when you are at home! PrePass Plus & Tolls This is a blue device on each windshield that will help you with unnecessary stopping along your trip. This device can help you bypass weigh stations. There is a manual (it’s a small booklet) in your truck on exact instructions on how to best use it and read the lights. Use this manual for all instructions on how to use the device. The following is not meant to overrule it. If the device or manuals are ever lost or damaged, the driver will be charged the replacement fees. Please do not place a GPS or electronic devices near your blue PrePass Plus device, as it will interfere with the signals & you won’t be able to bypass. The basics for a weigh station: Always be in the right lane coming up to a weigh station, otherwise the PrePass might not read and you’ll need to pull in. Red light (or no light) means that you need to pull into the weigh station, and a green light means that you can bypass. Tolls need to be paid in cash – have enough on you! Bring in to the office a receipt and the money will be reimburse in your settlement. Toll road 550 here in Brownsville, that connects 83 to the Port of Brownsville is off limits. Instead, take the parallel road 511. Roadside Inspection Reports Every original clean inspection report that is turned in with the trip paperwork is worth an additional $25 in your paycheck. Some drivers want a copy of inspection reports for their own records – one will be provided to you free of charge upon request. It is important that the original stays with the company. Protect yourself and understand what you are singing before the officer gives you a ticket or inspection report. Once you sign the inspection report everything on this report is truth. There are ways to fighting these reports to change something you think is unfair, but a lot of evidence is required. So if you think something is unfair, do not sign it, or at the very least take a lot of pictures to prove your innocence. Initial Stating Understanding and Agreement *NextTickets, Citations, and Convictions Depending on whether you had a roadside inspection, received a ticket or warning, or were convicted of a traffic or motor vehicle related offense, there are different reporting requirements. There are reporting requirements for commercial vehicles and non-commercial vehicles! (This includes your personal car or truck). *- You are deemed ‘convicted’ of a crime if: You were judged as guilty; There was a determination that you have violated or failed to comply with the law by a court of original jurisdiction or by an authorized administrative tribunal; Your bail or collateral that was deposited to secure your appearance in court is forfeited; Your plea of guilty or nolo contendere (no contest) is accepted by the court; You had to make a payment of a fine or court cost; or you violated a condition of release without bail, regardless of whether or not the penalty is rebated, suspended, or probated. (Adapted from FMCSR definition) Depending on the offense, and its severity Transcar Express may choose to exercise a disciplinary action ranging from verbal warning to immediate termination. Drivers will also be subject to immediate termination by its insurance companies based upon new items showing up on a personal Motor Vehicle Report (MVR). Driver Base Pay Drivers are paid per dispatched mile depending on the type of trailer being hauled, as such: *-Driver is responsible to ask for any additional bonus to be added in their settlement. * - Team Driving pay is different, please ask the office for current pay policies for team drivers. Drivers that Join the company under a training program, needs to work for Transcar as a driver for one whole year, otherwise company will keep the Escrow fund they have. Mileage is run off of our truck routing software called Prophecy Dispatch, from dispatched city to dispatched city. These miles are based upon the shortest truck route possible and is non-negotiable. Company drivers are paid loaded and empty miles at the same rate, and Owner Operators are paid an additional $1/mile after 150miles of empty. If at any point you feel that you will not be able to take the shortest truck route, please call the office for guidance. Truck owners will also have a separate lease agreement to abide by and sign. Owners are required to keep strict maintenance records and keep these records with our Safety Department. If an Owner’s truck gets an inspection that results in an out of service, they will not get dispatched again until necessary truck fixes are made. Too many violations will be grounds for termination. Company Drivers are sent from location to location by our dispatch team. Pick up and drop locations are approved by dispatch with our clients and cannot be rejected by a company driver – this is what some companies call “forced dispatch”. Beyond its scary name, this is really a good thing for everyone involved. It creates stability for the entire team of drivers as well as office personnel, but especially for our clients. Therefore, all our drivers are expected to be able to drive in all 48 States, at any time of the year. Now, a driver may express a desire not to go into a certain area, and because we understand that desire the dispatch team will agree to try their hardest to navigate around it; however, we cannot guarantee any ‘no-go’ zones for any of the drivers. If a driver happens to be dispatched to an area that they have requested not to go into they will still be required to drive that route just like any other. (NOTICE: Requesting not to go into certain areas might result in a pay decrease – the stated pay is for OTR drivers willing to go into all 48 states). Initial Stating Understanding and Agreement *NextLayover & Canada Pay Layover is only an option for company drivers and is only ever considered after 48 hours of sitting (not 47 hours). It is paid in 24 hour increments of non-movement, with the first 24 hours not being paid. Layover will only be paid if not because of a driver error, or a lack in appropriate trip planning. Layover must be approved by dispatch within 3 days of it happening. If layover is asked for when you hand in paperwork, it will be automatically denied. Be sure to ask for it when you are on the road. Canada pay is also an option only for Company Drivers. Every time you cross an international border you are eligible for an extra $50. Diesel Fuel Purchases You will be given a company fuel card. You must use this card to purchase diesel fuel, DEF, and other additives such as oil. We require that our drivers only fuel at llocations. You MUST get authorization to fuel anywhere else, before pulling into that truck-stop. Drivers will be charged $0.30/gal for fueling anywhere else without authorization. Plan your trips well- don’t let this happen to you. Drivers also need to grab duplicate fuel receipts after filling up. Place these receipts into your trip jacket when turning in your paperwork. You need to plan you trip comcheks for diesel ,if necessary when there’s no Loves, can and will ONLY be authorized from 8am-5pm. Initial Stating Understanding and Agreement *NextCash Advances & Other Trip Expenses Cash advances will be made on your fuel card are limited at any given time to $40 per day and NON ACCUMULATIVE Transcar Express will not reimburse any fees incurred at the location of withdrawing the cash advances, most places will let you withdraw reasonable amounts at a time without a fee when you fuel up your truck. Driver is responsible for all commission fees for cash advances, comchecks, and fuels in case card gets stolen or lost. Be Prepared and plan your trip, ask for money ahead of time, NO personal cash advances, or toll money will be given after office working hours (M-F 8am-5pm) or during the weekend. Emergencies only. NO Exceptions. ComData charges for creating a cash advance depending on how it is withdrawn. Fees will be passed on to the driver when it is a personal withdrawal. $2.50 Advance on the card, with fuel purchase $2.50 Advance on the card, without fuel purchase $5.25 for Express Check first withdrawal $2.00 for Express Check withdrawal, after the first withdrawal. All cash advances written for you or your truck are counted against your next check, even if they are for truck expenses such as service. Make sure you get and keep all receipts to make sure that you are reimbursed that money! No receipt means no reimbursement. Trip expenses (except for tolls, and diesel) require authorization before purchasing. Purchases made without authorization or a receipt will not be reimbursed. On the top of the receipt put the name of the person who authorized your purchase, and the date it was authorized. Advice: Protect yourself and get authorization via text message as proof! Transcar Express will not reimburse 2payments for parking, except in California and outside of Detroit in Michigan. Please plan your trips to account for this. (Old receipts that not fall into the current trip dates, will not be reimbursed).Trip expenses (except for tolls, and diesel) require authorization before purchasing. Purchases made without authorization or a receipt will not be reimbursed. On the top of the receipt put the name of the person who authorized your purchase, and the date it was authorized. Advice: Protect yourself and get authorization via text message as proof! Transcar Express will not reimburse 2payments for parking, except in California and outside of Detroit in Michigan. Please plan your trips to account for this. (Old receipts that not fall into the current trip dates, will not be reimbursed).Customer Service, Load Protection, & Trip Planning Customer service is one of the biggest priorities for our company. Our customers are both shippers and receivers, so instead of explaining who is the customer every load, we ask that you treat everyone as if they were. When you pick up and drop off a load for Transcar Express you are our representative. Always be early to pick up and early to drop off, and plan for the unexpected (bad weather, heavy traffic, breakdown, etc.). Always be clean and dress appropriately. Always be respectful to everyone even when you are not being respected. Always go over and beyond. Follow the Golden Rule. Ultimately cargo securement and placement on the trailer is the driver’s responsibility, so be very cautious with how shippers are placing it on your trailer – think about both safety and weight distribution. Always ask and see if the shipper requires chains only or straps only, and if a tarp is required. When in doubt always tarp your load. Use appropriate protection for your load and equipment – like edge protectors. Plan your trips well! Know your route, where you are going to need fuel, and any other stops you are going to need before you leave the shipper – and if they don’t allow you to stay on property to do this planning, find the nearest safe place to park to figure this out. If you plan your trips well, you will never be late and you will never have to fuel at an out of network location. Delivery Times If dispatch does not give the driver a set pick up or delivery time, then the truck and/or load is expected as soon as possible. Drivers are expected to always give dispatch an estimated time of arrival (ETA) for pick up or delivery before taking off – as to always be keeping in best communication. If dispatch does give a driver an appointment time, it is expected that the driver will be early, so that at the very latest, the load will deliver on time. If dispatch give the driver an appointment time, and they are late because of driver error, the driver will be charged a flat rate of $50, plus $10/hr. after the first hour. This will be on top of any fee that the broker decides to deduct from the rate. Drivers will not be charged for a late appointment time because of weather, traffic, long DOT inspections, Truck or Trailer Out of Service, or other driver uncontrollable reasons. It is up to dispatch to schedule loads on a reasonable time table. If an appointment time is unreasonable, it is up to the driver at the time of dispatch to give a good reason on why it is impossible, and to suggest a new time. Initial Stating Understanding and Agreement *NextPay Deductions, & Company Fines Our company has a very low tolerance for illegal behavior, and there is no exception for logbook violations – this goes for both company drivers and owner operators. When running paper logs, it can be very tempting to “fix” your logs to create longer driving time over shorter periods – we do not tolerate this sort of behavior. If you are written up for a logbook violation, either a citation or a warning, the company will fine you $150, and it will come out of any pending check that you may have with us. None of the logbook fines go into the company pocket but into a pool for a year end safety bonus. All drivers who end the year with absolutely no logbook citations or warnings will be eligible to split all of the money that has come in! Loads requiring tarps, extra care, etc., will be the driver’s responsibility, to know about and do. Each truck has been provided with a cargo securement handbook, refer to this with any questions on how to properly secure a load. Always ask the shipper their securement preference (e.g. chain or strap). The driver, not the company, will be responsible for fees or fines associated with not doing what’s required in terms of both securement and protection. Lumper Fees All lumper fees need to be reported to the office within 24hrs of paying for it. If not, you risk not being reimbursed for the fee. You can pay with your own money or a ComCheck from the office. Either way keep the receipt with a date and location on it. Call the office during normal business hours to receive a ComCheck. Worksite Safety Rules It is on the driver to follow and obey all safety rules and safety personnel of any jobsite, worksite, or warehouse, etc. If you feel that a worksite is unsafe, after politely trying to reach out to a member of the location safety team, please contact the office to get this sorted out. Your safety is our priority! Personal GPS Devices Please make sure that your GPS allows truck routing and that it is set for shortest truck miles, with no exceptions for toll roads or highways, etc. If you need someone to look at it to make sure that it is set correctly, please bring it into the office. We’ll be happy to take a look at it. Transcar Express allows its drivers to find and create their own routes, with one rule: make it the shortest truck route possible. Transcar will not provide that route for you, that is part of the driver’s job. We allow up to a 5% difference in shortest truck route miles to the miles from your odometer before we start asking questions, or imposing penalties. Safe & Distraction Free Driving A safe driver is always the best driver. We expect all our drivers to perform their best by exceeding the safety requirements of all laws and regulations required for driving the equipment you’re assigned to. As a few general rules while you are driving, unless changing gears, always have your hands on the “ten-and-two” positions of your steering wheel. Always have your seatbelt on before starting your vehicle, and do not take your belt off until safely in park. Distracted driving is unacceptable at Transcar Express, as it is an immediate safety hazard to you, and the people around your vehicle. Therefore, the following is prohibited while driving: - Cell phone operation - GPS operation - Handheld device operation - Eating - Writing - Updating your logbook - Reaching for anything - Radio, Music, Audiobooks, etc. at high volumes If you would like to do any of the above activities, please make sure that you are safely parked, and not driving. Initial Stating Understanding and Agreement *NextRequired Trip Paperwork – The Trip Envelope In order to be paid, you need to turn in all of the following paperwork in your trip envelope. You can request these in the office: A completely filled out and signed Trip Envelope (front & back) All original signed Bill of Ladings (BOLs. If none given at shipper, please make one) Duplicate Receipts of all Diesel Transactions (Prepaid Receipts will not be reimbursed!) Receipts of all other expenses – No receipt, no reimbursement. All driver daily logs for that trip, including DVIRs Any and all tickets, warnings, & inspections (including those from personal vehicles). Once paperwork is handed in completed, please allow until next business day at 4:30pm to receive your pay. If you are missing a receipt and it is turned in a day late, time until you get your pay will be from when you handed in your last receipt – so make sure everything is gathered correctly and completed before you hand anything in! Payment schedule is as follows, due to volume of settlements: Checks will be ONLY given from 4:30 to 5:15pm during the week and on Saturdays 12pm-12:30. Please be in the office before issuing the checks. We will not leave outside any checks. Monday thru Thursday will be paid the following day after 4:30pm. Fridays, we will receive driver’s envelopes until 12:00 PM to be payable on Saturday, all driver’s envelopes delivered from 12:01 PM to 5:00 PM will be payable on Monday. Friday after 5:00 PM and Saturdays and Sundays will be paid on Tuesday after 4:30. Home Time, Road Time, & Vacation Time Home time depends upon length of time on the road. The following rubric will be used to assess home time. Days on the Road: 0-5 days 6-9 days 10-14 days 15-20 days 21+ days Days at home: 1 full days 2 full days 3 full days 4 full days 5 full days Example: Come home Monday, leave Wednesday Come home Monday, leave Thursday Come home Monday, leave Friday Come home Monday, leave Saturday Come home Monday, leave Sunday The date you are to show up will be given to you with your paycheck, for your convenience. However, if you did not receive a notice please check with dispatch- you will still be required to show up for work at the necessary time. If you are available, or want to leave earlier, please let us know! There is flexibility in extending these days for sudden traumatic incidents, and for family events – these cannot be used often but will be allowed when needed; and often times in exchange for longer trips in the future. Talk to dispatch about getting an exception. A company fine will be assessed for not showing up when required: $200 per day. If after the third day, you have still not shown up, or called, we will assume you have quit without two-week notice, and abandoned your truck and all possessions in it. At that time, we will clean out your truck and give it to a new driver. Personal affects left in the truck will be trashed or given away, and any money left in escrow will be forfeited. Drivers may ask for unpaid vacation time; starting the 1st of the month, after 180 days of employment. Vacation requests are considered on two factors: length of employment with Transcar Express and percentage of time on the road, versus time at home. Company goal is to have each driver between 80% and 85% time on the road. Drivers with more than that are more likely to be granted time off, while drivers with less than that are less likely to be granted time off. Your percentage of days worked will always be on your settlement, so that you can track your progress. Initial Stating Understanding and Agreement *NextHealth Insurance Plan One of the benefits you can obtain by working with Transcar Express is a medical insurance. The driver will be eligible to pay for medical insurance after 90 days of being employed through Allied National. They provide affordable and convenience access to excellent primary medical care. The health Insurance Transcar offers is only valid for the employee. If for any reason you need to include your family, you need to contact our Health Insurance broker for details. (please contact Human Resources personnel and information will be provided). Transcar Express will be responsible to cover 50% of policy coverage, the other 50% will be covered by the employee. if employee decides to get covered, policy needs to be paid every 1st. day of the month. Also, if employee decides to get the health insurance, the payment rate will be decreased .04 cents per mile, due to Transcar Express cannot offer both benefits. y type (ex: phone violation fees, citations, logs violation fess). Scheduling your week will be subject to availability. If any employee gets a compensation as a bonus, reward or any other incentive, a picture will be taken and Transcar Express reserved the right to make public those pictures for advertising purposes. Background Check Reminder As stated in your employment application agreement, as well as right here, Transcar Express has the right to run a full & partial investigative report at any time and as many times as desired while employed, without notice. You have the right to request a copy of previous checks and request a new check, each for a fee. Whenever a disciplinary action is taken, it is not a way to push you out of our company, but a way in which we can push you to be an even greater employee than you are. Disciplinary action is always recorded to track progress and to prove that proper actions were taken in light of certain events. Ongoing Driver Qualification Requirements Commercial Driver’s License: 30 days before your license expires, you will be required to renew it and provide the paper “temporary license” to the office before being dispatched for your next load. This temporary license is usually good for 6 weeks. Once your plastic license comes in the mail, please bring that in as soon as you can, and before your temporary license expires so that we do not need to place you out of service. Medical Card: All drivers will be required to update their medical card between 60 and 45 days of it expiring. Once you have renewed your medical card, please make sure you go to the Texas Driver’s License Office to add your medical card to your driver’s license – as required by current regulation. 30 days before your medical card expires your MVR will be run, and if it does not show an updated medical card, you will be put out of service until that is updated. Convictions & Suspensions: See the above “Tickets, Citations, and Convictions” sections for more information on this. However, it is on the driver to report to the company if you have been convicted of a traffic violation or if you have received a notice in the mail to warn of a license suspension or revocation. If, for any reason, you have forgotten to report something to the company, each year we will review your employment (AKA Annual Review) and this will be your time to report any unreported traffic violations. Failure to properly notify the company of a traffic conviction or license suspension can result in termination of employment. What this means is that a small amount will be deducted out of each check until you have reached the mandatory minimum account balance of $1,000 for company drivers. This account works for both the company and the driver because if on any given trip a driver error occurs and there is damage or loss to the truck, trailer, load, or things inside, customer property damage, truck recovery, etc., or because of a violation of an applicable company policy, then it can come out of your escrow account balance, reducing the financial stress on the company and reducing the need for driver debt. An online database providing employers, licensing agencies, and enforcement officers with real-time information about truck and bus drivers who have violated DOT drug or alcohol testing rules. Employers must check the Clearinghouse when hiring each new CDL driver and every year for existing CDL drivers like you. The Clearinghouse will affect you in several ways: 1. You will need to register on the Clearinghouse website (available Fall 2019) in order to comply with item #2 below.
